National Anomaly Committee-Meeting of the Joint Committee on MACPS Anomalies


Sub: – Meeting of the Joint Committee on MACPS Anomalies



As decided in the National Anomaly Committee Meeting held on 17/07/2012,the Dop&T held separate meeting with the Leaders of Staff Side at North Block, New Delhi, Room No.190 on 27/07/2012. Shri M.Raghavaiah, General Secretary, NFIR has participated in the meeting.

Discussion were held on the following  issues

1. Grant of MACP in the promotional hierarchy: 
The Staff Side (NFIR) insisted that option be given to individual employee in this regard to facilitate him/her to opt for availing benefit of financial upgradation.

After discussion it was agreed to examine in depth for finding solution



2. Date of effect of MACP Scheme 
The desirability of giving effect to the MACP Scheme w.e.f.01/01/2006 will be examined.



3. Counting of total temporary status Casual Labour service for reckoning 10/20/30 years under MACP Scheme: 
Official Sides tated that this will be processed separately.



4. Treatment of employees selected under LDCE/GDCE Scheme: 
In the light of the instructions issued when the ACP Scheme was introduced,the same policy be adopted and accordingly orders will be issued.In other words,those inducted through LDCE/GDCE Scheme, such induction may be counted as appointment and will not be reckoned as promotion.



5. Problems faced in the identical Grade Pay:

It was agreed to issue instructions for granting additional increment for fixation of Pay in case of promotion to the same Grade Pay. Instructions in this regard will be issued to Ministry of Railways etc..



6. Financial Upgradation under MACPS, in the case of staff who joined another Unit/Organisation on request:

The Staff Side (NFIR) has pointed out that OM dated 01/11/2010 should be suitably amended covering the staff who were transferred on request on reversion to the Unit/Organisation so that the total service rendered in the previous Unit/Organisation may be counted for MACPS. It was agreed to consider

7. Extension of benefit of MACPS to an employee appointed in Grade where direct recruitment element is there while ignoring service and promotion rendered prior to his appointment in that post:

Official Side reiterated that suitable clarification N o.5 of OM dated 09/09/2010 was already issued.staff side stated that this will be checked up.



8. Stepping up of Pay of Senior incumbents at par with Junior incumbents as a consequence of ACP/MACPS:

Staff Side (NFIR) has explained the case of gross injustice done, more particularly in the Accounts Department of Indian Railways wherein the incumbents who cleared the Appendix examination are drawing less pay than those who could not qualify the said examination and got the benefit of MACPS. The staff side (NFIR) insisted that this situation is leading to de-motivation among the qualified staff and urged for rectifying the anomalies is. It was agreed to consider and Ministry of Railways advised to send the proposal



9. Employees who got one promotion prior to 01/09/2008 and completed over two decades of service without benefit of promotion and are denied third ACP under MACPS:

After discussion Official Side agreed that this is a peculiar situation and assured to take action for remedying the situation. The Staff Side (NFIR) has insisted that in such cases third ACP should be straight away given to the staff from the date subsequent to the date of completion of two decades of service after first promotion. 
Official Side appreciated the logic and reasonableness and agreed to consider.



10. Modification of recruitment rules particularly in Railways and upgradation granted by abolition of Pay scale – Implementation of MACPS:

The Staff Side (NFIR) explained that in the Railways the lower Pay Scales were abolished and posts were upgraded to the higher Pay Scales with revision of recruitment qualification and designation. In such cases the Staff Side insisted that entry Grade Pay as a result of upgradation subsequent to abolition of lower Pay Scale  s should be taken into consideration for reckoning 10/20/30 years of service for granting MACP Official Side has agreed to obtain details from Ministry of Railways for issuing appropriate clarification. In the mean while,Railway Board will have discussion with the Staff Side separately so that appropriate proposal could be sent to the DoP&T.



11. Placement of staff as a result of upgradation of posts: 
The Staff Side (NFIR) insisted that such placements should not be considered as promotion for the purpose of grant of financial upgradation under MACP Scheme. Official Side stated that this will be examined.

12. In the course of discussion the Official Side also stated that MACP Scheme should be a fall-back option and the Ministries should conduct Cadre Restructuring for ensuring that the staff could be promoted within the reasonable time i.e. within 10 years. When the Staff Side pointed out that the Ministry of Railways is citing the 
instructions of Ministry of Finance issued some years back that only one third of the Cadre could be disturbed,for revising the percentages the Official Side clarified that necessary clarificatory instructions will be issued to the Ministry of Railways etc.,so that the Cadre Restructuring can be done without problems.

Clarification regarding grant of benefits of MACPS to officers who have later on inducted into Organized Group A Services

Subject: Modified Assured Career Progression Scheme for the Central Government  Civilian Employees — Clarification regarding grant of benefits of MACPS to  officers who have later on inducted into Organized Group A Services -

In terms of clarification given on point of doubt no. 2 of Annexure of this Department’s O.M. dated 09.09.2010, no benefits under the MACPS would be applicable to Group A officers of Organised Group A Services, as the officer under organized Group  ’A’ Services have already been allowed parity of two years on non-functional basis with  the officers of the Indian Administrative Service (IAS). In this regard, this Department is in  receipt of a number of references from various Departments in respect of officers who are  deprived of the benefits of MACPS due to their induction into the organised Group A  Services at a later stage of their service.

2. The issue has been considered by this Department in consultation with Department  of Expenditure. It has been decided to allow grant of financial up-gradations under  MACPS with effect from the due date to those officers who are inducted to the Organized Group ‘A’ Services when they are nearing retirement subject to the condition that only at  the time of retirement an evaluation of up gradations/ promotions earned by the officer  would be made. In case such officers have already attained three financial upgradations
under MACP Scheme, they shall not be entitled for NFU to the same grade from a later date.

Amendment to Recruitment Rules for scientific posts as per Modified Flexible Complementing Scheme based on 6th Central Pay Commission recommendations

Subject: Amendment to Recruitment Rules for scientific posts as per Modified Flexible Complementing Scheme based on 6th Central Pay Commission recommendations.

          Attention is invited to modified FCS for Scientists based on 6th CPC recommendations issued in this Department's OM of even number dated 10.9.2010. It has been laid down that assessment of Scientists from 1.1.2011 shall be done according to the revised provisions of the scheme.Accordingly, all the Ministries / Departments were advised to initiate action for review of the provisions of FCS and amend their recruitment rules to bring the scheme in their organization in conformity with the guidelines of DOPT.

2. The proposal for amendment of the RRs for incorporating the revised scheme have not been received from most of the Scientific Ministries / Departments. The revised guidelines have been issued in  September 20 10 giving sufficient. time for the Ministries / Departments to  take action for amendment of the RRs. The guidelines of DOPT issued  earlier make it clear that the promotions under FCS shall be from a  prospective date only after the competent authority has approved the same. Under the circumstances, action should have been taken by now to amend  the RRs so that assessment of Scientists could be carried as per the revised  Scheme.

3. Accordingly the Ministries / Departments are advised to take immediate action in this regard to amend the RRs so that assessment of  Scientists could be carried as per the revised Scheme.

SUMMARY RECORD OF DISCUSSIONS HELD DURING THE THIRD MEETING OF THE JOINT COMMITTEE ON MACP’S HELD UNDER THE CHAIRPERSONSHIP  OF THE JOINT SECRETARY (ESTABLISHMENT), DOP&T ON 15th MARCH 2011

1. The third meeting of the Joint Committee constituted to examine the anomalies pertaining to the MACP scheme was held under the Chairmanship of Joint Secretary (Estt.) Department of Personnel & Training on 15th March, 2011. All the members of the Committee were present in the meeting.

2. The Chairperson welcomed the representatives of the Official Side and the Staff Side and stated that with respected item numbers 13, 21, 27, 28, 32, 38, 44, 50 & 58, suitable instructions had been issued vide this Department’s O.M. dated the 1st November, 2010. She also informed that as per the decision taken in the second meeting of the Joint Committee, vide this Department’s O.M. dated 10th February, 2011, all concerned have been advised to review the cadre structure in a time bound manner with a view to mitigate the problem of stagnation

3. Thereafter, the agenda items which were still pending were taken up for discussion.

Item numbers 1,3,8, 9 & 29-Grant of financial upgradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS.

The Staff Side reiterated their demand that the financial upgradations under the MACP Scheme should be granted in the promotional hierarchy of posts instead of the Grade Pay hierarchy. The Staff Side stated that the erstwhile ACP Scheme was implemented on the recommendations of the 5th CPC and, as such, has become a part of the service conditions of the employees. The Staff Side, therefore, contended that the Government cannot impose the MACP Scheme thereby altering the service conditions to the detriment of the employees.

The Official Side stated that the 6th CPC recommended two financial upgradations in the Grade Pay hierarchy after 12 and 24 years. However, the Government improved upon the recommendations of the 6th CPC and has implemented MACPS with three financial up gradations in the Grade pay hierarchy after 10, 20 & 30 years. Referring to earlier discussions held in the matter, the Official Side stated that the Government was willing to consider revision in para 13 of the MACP Scheme to the effect that organizations I cadres shall have the option to choose either the ACP scheme or MACP Scheme. However, the Staff Side pointed that such a dispensation will not be practical and hence there is a need to explore other alternatives to solve the issue. After discussion, it was agreed that there is no need to change the basic structure of MACP Scheme. However, there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. Accordingly, it was decided that the Official Side will write to the Ministry of Railways, Defence, Urban Development, Home and the Department of Posts to forward information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme The Official Side also requested the Staff Side to collect and forward such information to the Department of Personnel 8 Training for further necessary action. I’n this connection, the Staff Side specifically pointed out the case of Technician category wherein under ACP (w.e.f 1.10.199) the staff got upgradation to Rs.4500- 7000 (V CPC) on completion of 24 years whereas under MACPS they get the same benefit, i.e. Grade Pay of Rs.2800 afler 30 years.

Item Nos. 2,7,20 8 48-Date of Effect of MACP Scheme

The Staff Side stated that many employees who retired between 1.1,2006 and 31st August, 2008, have been deprived of the benefits of MACP Scheme and therefore, demanded that the MACP Scheme may be made effective from 1.1.2006. The Official Side stated that the matter was discussed and finalized in the second meeting of the Joint Committee and therefore, there was no reason to reopen the matter. After discussions, it was decided that the matter may be treated as finalized so far as the Joint Committee on MACP IS concerned and if required, the Staff Side may raise this issue in the next meeting of the National Anomaly Committee.

Item Nos. 57 – Grant of ACP benefit to Artisan Staff of the Ministry of Defence

The Staff Side stated that consequent upon the recommendations of the Fast Track Committee, the highly skilled Artisan Staff of the Ministry of Defence was bifurcated in two categories, i.e., Highly Skilled -II (with Grade Pay of Rs.2400/-)and Highly Skilled-I (With Grade Pay of Rs.2800/-). The Staff Side contended that this bifurcation, in the first instance, may be treated as placement and not as promotion for the purpose of MACP. The Official Side stated that as per the extant instructions of the Department of Personnel 8 Training, where the whole of a cadre is placed in a higher scale, such placement is not treated as promotion. However, when only a part of a cadre is placed in a higher scale, then such placement is treated as promotion for all purposes including MACPS. The Official Side further stated that even under the erstwhile ACP Scheme similar practice was followed and there is no reason to deviate from that.

The Staff Side cited a Supreme Court judgment in the case of Union of India Vs V.K. Sirotia reported in 1999 Supreme Court cases (L&S) 938 that where certain percentage of post are granted higher pay scales to seniors in the cadre will be treated as placement and not promotion. The Staff Side also cited the Manual of instructions for restructuring of cadres in 1.A & A.D (para 3.2.8) wherein it has been stated that the Screening Committee in combined Audit & Accounts Offices besides selecting persons for transfer to audit offices will also decide on their placement (& not promotion) against the higher scale posts.

After prolonged discussions, it was decided that the matter would be re-examined by the Department of Personnel & Training in consultation with the Department of Expenditure.

Item Nos. 12,30 & 49 – Treatment of employees selected under LDCE Scheme / GDCE Scheme.

The Staff Side demanded that employees selected under the LDCE Scheme / GDCE Scheme should be treated as a direct recruit and their earlier promotions and services rendered should be ignored for the purpose of MACPS as was being done in the ACP Scheme. The Official Side informed that treatment of such cases would generally be same in MACP as was in the ACP Scheme. Ministry of Railways would be advised to examine the matter accordingly.

Item Nos.11.15.22.39.47 & 51- Promotion in the identical Grade Pay

The Staff Side raised the issue of promotions in the identical grade pay and demanded that in such cases the benefit of one increment should be granted at the time of promotion. ‘The Official Side stated that if regular promotion is to the same grade pay, then MACP would also be granted to the same grade pay. On the issue of whether one increment is to be allowed in such cases, a reference has been received in the Department of Expenditure from Ministry of Railways. Further action in the matter would be taken consequent upon receipt of certain information from Ministry of Railways as called for by the Department of Expenditure.

4. After discussion on the agenda items, the Staff Side stated that in many instances the provisions of the MACP Scheme were being misinterpreted by various Ministries/ Departments thereby causing financial loss to the employees. The Official Side stated that many Ministries/ Departments had sought various clarifications regarding the provisions of the MACP Scheme which has been given. In addition, many clarificatory Office Memoranda have also been issued by the Department of Personnel & Training to allay the misgivings misunderstandings regarding the Scheme. However, if certain misgiving misunderstandings were still continuing, the respective Ministries/ Departments may be advised to refer the matter to the Department of Personnel & Training for resolution of the same.

5. In the end, it was decided that the recommendations of the Joint Committee on MACP Scheme along with the action taken report may be discussed in the next -meeting of the National Anomaly Committee.

MACP sub committee meeting minutes


The Record note on the meeting of Joint Committee on MACP held on 15.03.2011.

The third meeting of joint committee on MACP was held today i.e 15.03.2011. This meeting was held at the specific request by the Secretary Staff Side, National Council JCM to review the decision taken in the earlier meetings in which all items had been discussed.

Item Nos. 1,3,8,9 and 29:  Grant of financial up-gradation in the promotional hierarchy instead of grade pay hierarchy under MACP Scheme

The Staff Side pressed this demand on the ground that the ACP 1999 had become a service condition in respect of all those who were in service as on 31st August 2008. The MACP Scheme being less advantageous could not be imposed upon them. They stated that to resolve this anomaly, the first 2 ACPs may be continued in the promotional hierarchy to be granted after 12 and 24 years of service from the date of induction, the third ACP on completion of 30 years service may be in the grade pay hierarchy. The official Side did not agree with this proposal. The Staff Side then pointed out that the introduction of MACP Scheme in grade pay hierarchy 10, 20, 30 years of service from the date of induction will result that certain cadres would be placed in the grade pay which are not sanctioned in the structure of the departments and therefore it can not be treated as career progression at all. The official Side wanted the particulars of those cadres which are going to face this problem, so that they could consider how to overcome such anomalies. The Staff Side agreed to provide the necessary information and departments concerned may also be asked to provide such information.

Item Nos. 2, 10 and 48: 
The Staff Side also pressed for introducing MACP Scheme with effect from 1.1.2006 so that those who did not get any benefit under old ACP could atleast get the MACP scheme benefit before their retirement during the period from 1.1.2006 to 31.8.2008. The Official Side stated that this item has been closed and concluded and can not be allowed to be opened / reviewed. The Staff Side then stated that they would like to raise this issue in the meeting of National Anomaly Committee as the joint Committee on MACP Scheme is sub committee of the National Anomaly Committee. The Official Side stated that this may be raised as afresh item in the National Anomaly Committee. The Staff Side also wanted that the option to choose ACP or MACP should be given to the individual employees and not the Department. The Official Side also did not agree to reopen this issue which has been concluded in the last meeting.

Item No. 57: Ignoring the placement of Artisans of Ministry of Defence from HS grade II to HS grade I for the purpose of MACP Scheme. 

The Staff Side pointed out that this restructuring by keeping 50% of Artisans in the HS grade I and placing 50% in the HS grade II was by way of placement and therefore it could not be treated as promotion. The Staff Side cited Supreme Court ruling to this effect. However the Official Side did not agree with this. The case of restructuring in IA & AD in 1984 and in organized accounts were also cited in which it was clearly stated that those who are in the higher grade would be treated as placement only those who are promoted later on against vacancies would be treated as promotion. The official Side view was that only in those cases where the entire cadre is placed in the higher pay scale it would not be treated as promotion. This matter will also have to be raised in the meeting of National Anomaly Committee.

Items Nos. 11, 15, 22, 39, 47 and 51: Promotion in identical Grade Pay.

The decision that the normal promotions are in the same grade pay, they cannot be ignored for purpose off MACP Scheme and the specific cases would be examined separately.

Item Nos. 12, 30 and 49:  Employees appointed limited competitive examination from lower to higher post may treated as direct recruits in the higher post ignoring the service in the lower posts. 

The matter is still being considered with reference to old ACP scheme clarification.

Item Nos. 13, 32, 38, 44, 50 and 58:  Counting of old service in the new establishments for the purpose off MACP. And  Item Nos. 21, 27, and 28: 

Benchmark for financial up gradation under MACP. Orders have been issued on 1.11.2010.

It was agreed that action taken statement would be finalized and circulated so that further discussion thereon can take place in the meeting of National Anomaly Committee.

Subject: – Adoption of Modified Assured Career Progression Scheme (MACPS) for the employees of Kendriya Vidyalaya Sangathan at par with Central Government Civilian Employees.

The matter pertaining to adoption of Modified Assured Career Progression Scheme (MACPS) for the teaching and non-teaching employees of Kendriya Vidyalaya Sangathan, at par with Central Government Civilian Employees, was under examination with the Ministry of HRD.

2. The approval of the Ministry of HRD, Govt. of India, as conveyed vide their letter No.F.3-18/2010 UT-2 dated 20th January, 2011, is communicated for adoption subject to the following conditions:

*MACP Scheme is extended to the Non-academic (non-teaching) Group ‘B’ &’C’ employees of KVS.

*The guidelines issued by the Department of Personnel & Training vide O.M. No.35034/3/2008-Estt (D) dated the 19th May, 2009, shall apply mutatis mutandis. (Annexure I).

*This scheme is in supersession of the previous ACP Scheme and clarifications issued thereunder and will be applicable w.e.f. 01.09.2008.

*The MACPS envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pav bands and grade pay as given in Section I, part A of the first schedule of the CCS (Revised Pay ) Rules,2008. Thus the pay band and grade pay at the time of financial up-gradation under the MACPS to the Non-academic (non-teaching) Group ‘B’ &’C’. employees of KVS will be given as per Annexure II.

*To make the MACP Scheme operational, the competent authorities shall ensure the conduct of first screening committee within one month from the date of issue of the OM and all eligible cases should be cleared within two months.

*The screening committee shall be headed by a Chairman and will consist of at least three members who shall be not below the rank of Under Secretary (i.e. pay band 3 with grade pay of Rs.6600/-), of which one member shall be belonging to SC/ST/Minority community. The recommendations of the screening committee shall be placed before the appointing authority for approval.

The 2nd meeting of the MACP Committee

The 2nd meeting of the MACP Committee was held on 15th September, 2010.  The meeting was chaired by the Joint Secretary (Estt.) Department of Personnel and Training. Secretary General of  ‘Confederation of Central Government Employees’ posted a brief resume of the discussions on various issues taken up by the Staff Side, in his blog.It has been reproduced here for your reference. 

1. Item No. 1, 9 and 29,46: The demand was to provide for Grade Pay of the next promotional post under MACP as was given in the old ACP Scheme. This has not been agreed to. 

2. Item No.3. Option for each individual employee either to retain the old ACP scheme or to switch over to MACP. It was only agreed by the DOPT that they may consider giving option to the Department and not to the individual employee to retrain old ACP Scheme in respect of either the entire establishment of that Department or for a specific category or cadre of the employees of that Department. They also added that they may instruct the Administrative department to undertake restructuring of the cadres in consultation with the Staff Side which would secure quicker promotion. 

3. Item No. 8. Anomaly in respect of Junior Engineers of CPWD. The Official side agreed that CPWD may ask for option to retain the old ACP in respect of Junior Engineers which will be considered. 

4. Item No. 2, 10 and 48. The Scheme of MACP to be implemented with effect from 1.1.2006. Not agreed to. 

5. Item No. 7.Grant of financial up-gradation under ACP between 1.1.2006 to 31.8.2008 in respect of employees who have opted the revised Pay Band Grade Pay System with effect from 1.1.2006. Agreed to. 

6. Item No. 4 and 26. Applicability of MACP scheme to Group D employees placed in the grade pay of Rs. 1800 in PB1. along with the benefit of 3% increment in each stage of up-gradation. Covered by the clarification already issued by the Department of personnel ( See their website) 

7. Item No. 5 and 23. Counting of 50% of service rendered by a casual labourer with temporary status for reckoning the 10, 20 and 30 years of service for the purpose of MACP. They will examine the court ruling in this regard according which the entire casual service should count for the purpose of MACP. 

8. Item No. 6. Supervised staff placed in higher grade pay than their supervisor. The item has been transferred to the National Anomaly Committee for discussion. 

9. Item No.11 and 47. In the Railways and some other departments, promotion continues to be given in the merged pay scales, since these have not been functionally merged. It was demanded that in such promotion increment at the rate of 3% may be granted. The Official side has agreed to consider such cases, if taken up by the respective departments. 

10. Item No. 15, 22, 39 and 51.These would be considered in the Anomaly Committee of Railways. 

11. Item No. 12, 30 and 49. Those selected under LDCE/GBCE schemes may be treated as directly recruited personnel as was done in the case of old ACP scheme. The Official side agreed to look into it. 

12. Item Nos. 13, 16. 24 , 50 and 58. It was pointed out that under old ACP scheme in case of an employee who were reverted from higher post to lower post at this request ( to enable him to get transfer to another recruiting unit) the service rendered by him in the higher post was counted for the benefit of ACP. This should be extended to the MACP as well. The Official side agreed to issue necessary clarification in this regard. 

13. Item No.14. A departmental employee who has been appointed to a higher grade by virtue of his being selected in a Direct Recruitment Examination the ten, twenty and thirty years of service for the purpose of MACP to be reckoned from the date of such appointment. Necessary clarificatory order has been issued by the DOPT. ( Please see their website) 

14. Item No. 16. The service rendered by an employee who had resigned may be counted if he is given re-employment for the purpose of MACP. The Official side wanted this item to be processed separately. 

15. Item No. 17. The service rendered prior to removal or dismissal should count if he is reinstated on appeal or by Courts. The Official side stated that the past service will be considered if so ordered by the Court or the Appellate Authorities. 

16. Item No. 36. The service rendered in a State Government/Statutory body /PSU before appointment in the Central Govt. to be counted for MACP. Not agreed to. 

17. Item No. 37 and 38. Counting the probation period for the purpose of MACP. This is counted as per the scheme 

18. Item No. 42. Application of MACP to a surplus hand redeployed to lower post. This is covered under the scheme. 

19. Item No. 18 and 54. A person de-categorised on medical grounds to be treated as a fresh appointee. It was not agreed to . 

20. Item No. 41. The service rendered in higher grade who have been redeployed in the lower post on medical de-categorised on medical grounds may be counted under the MACP. The official side agreed to reiterate Railway Board's order issued in the year 2005. 

21. Item No. 19, 33 and 53. Stepping up benefit to seniors when the juniors get higher pay on account of financial up-gradation. The Supreme Court has given such an order. The Official side will examine this issue and the copy of the Supreme Court's order may be furnished to them. 

22. Item No.20. The Account Assistants in the Railways when appointed on qualifying the Appendix II Examination may be treated as a fresh appointee and his past service in the lower post be ignored. The Railway Board to process this case separately. 

23. Item No. 21.27 and 28. The Bench mark of good for entitlement to MACP benefit in cases where promotion to the higher posts is on the basis of seniority cum fitness may be done away with. Agreed to examine and issue necessary clarification. 

24. Item No. 24, 40 and 45. Counting of Training period. The induction training period would be counted. 

25. Item No. 25. The incentive may be given as applicable to the grade pay granted under MACP. This may be considered by the Railways. 

26. Item No.31. Extension of MACP to Staff Car Drivers and other Drivers etc. The orders have been issued separately. 

27. Item No.34. Pay fixation on promotion subsequent to the grant of MACP with an increment. This was not accepted. 

28. Item No. 35. Notional classification for Central Government employees Insurance scheme for those with Grade Pay of Rs. 4200 to be treated as Group B and covered by the scheme for Group B. Not accepted. 

29. Item No.43. There are several illustrations given relating to Railway employees. These were not discussed and each case was asked to be processed separately. 

30. Item No. 55. There are no provisions for grant of certain privileges/incentive on grant of MACP as was there in the old ACP scheme. The Item may be considered by the Railway administration.

The undersigned is directed to invite reference  to the Department of Personnel andTraining Office Memorandum of even number dated the 19th May 2009  regarding the Modified Assured Career Progression Scheme (MACPS).

Consequent upon introduction of the Scheme, clarifications have been sought by
various Ministries/Departments about certain issues in connection with implementation  of the MACPS. The doubts raised by various quarters have been duly examined and point-wise clarifications have accordingly been indicated in the annexure.

2  The MACPS should strictly be Implemented in keeping with the Department of
Personnel and Training  Office Memorandum of even number dated 19.05.2009 read
with the aforesaid clarification (Annexure)

3. All Ministries/Departments may give wide circulation  to the contents of this O.M. for general guidance and appropriate action in the matter.

(A) In the case of isolated post:

Clarification on MACP for Industrial Employees in OFB

Ordnance Factory Board.,Ministry of Defence ,issued a clarification on MACP for Industial Employees ,In which it is clarified that upto 31-8-2008 any promotion or upgradation from Semiskilled to Skilled Grade for those who recruited against Skilled vacancies should be ignored for the purpose of granting MACP wef.01-09-2008.
Industrial Employees of OFB in the grade of Skilled,Highly Skilled,MCM who were granted two ACP's before 31-08-2008 are entitled for 3rd MACP in the Grade Pay of Rs.4600 as and when they complete 30 years of service or 10years after getting 2nd promotion/ACP provided they fulfil conditions laid down in MACP order.

Reference is invited to the Department of Personnel and Training (D0PT)'s Office Memorandum of even number dated the lgth May, 2009 regarding the Modified Assured Career Progression Scheme (MACPS). Consequent upon the implementation of Sixth Pay Commissions
recommendations, the four pre-revised Group 'D' pay scales viz.,
Rs.2550- 3200, Rs.2610-3540, Rs.2610-4000 and Rs.2650-4000 have been upgraded and replaced by the revised pay structure of grade pay of Rs.1800 in the pay band PB-1. As per the recommendations of Sixth CPC, Governmentserants in these four pre-revised Group 'D' scales have been granted the Group 'C' revised pay structure of grade pay of Rs.1800 in the pay band PB-1.
It has been decided on the analogy of point-5 of Annexure-l of MACPS dated
19.05.2009 that promotions earned or upgradations granted under ACP Scheme of August,-1999 in the past to the four pay scales mentioned above, which now carry the grade pay of Rs.18001- shall be ignored for the purpose of MACPS. However, promotions/financial upgradations earned by existing Group 'D' employees to grade pay of Rs.1900 (pre-revised scale of Rs.3050- 75-3590-80-4590) shall be counted for the purpose of MACPS.

MODIFIED ASSURED CAREER PROGRESSION SCHEME-MACPS

SOME IMPORTANT ILLUSTRATION OF MACPS

· The MACPS envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay as given in Section 1 , Part-A of the first schedule of the CCS (Revised Pay) Rules, 2008. Thus, the grade pay at the time of financial upgradation under the MACPS can, in certain cases where regular promotion is not between two successive grades, be different than what is available at the time of regular promotion. ln such cases, the higher grade pay attached to the next promotion post in the hierarchy of the concerned cadre/organisation will be given only at the time of regular promotion.

· The financial upgradation s under the MACPS would be admissible up-to the highest grade pay of Rs. 12000/ in the PB-4.

· Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available. To illustrate, in case a Government Servant joins as a direct recruit in the grade pay of Rs. 1900 in PB-l and he gets no promotion till completion of 10 years of service, he will be granted financial upgradation under MACPS in the next higher grade pay of Rs. 2000 and his pay will be fixed by granting him one increment plus the difference of grade pay (i.e. Rs. 100). After availing financial upgradation under MACPS, if the Government servant gets his regular promotion in the hierarchy of his cadre, which is to the grade of Rs. 2400, on regular promotion, he will only be granted the difference of grade pay between Rs. 2000 and Rs. 2400. No additional increment win be granted at this stage.

· The pre-revised hierarchy (in ascending order) in a particular organization was as under: -Rs.5000-8000,Rs5500-9000&,Rs6500-10500
a) A Government servant who was recruited in the hierarchy in the pre-revised pay scale Rs. 5000-8000 and who did not get a promotion even after 25 years of service prior to 1.1.2006,in his case as on 1.1.2006he would have got two financial upgradations under ACP to the next grades in the hierarchy of his organization, i,e., to the pre-revised scales of Rs. 5500-9000 and Rs. 6500-10500.
b) Another Government servant recruited in the same hierarchy in the pre-revised scale of Rs. 5000-8000 has also completed about 25 years of service, but he got two promotions to the next higher grades of Rs. 5500-9000 & Rs. 6500-10500 during this period.

ln the case of both (a) and (b) above, the promotions/financial upgradations granted under ACP to the pre-revised scales of Rs. 5500-9000 and Rs. 6500-10500 prior to 1.1.2006will be ignored on account of merger of the pre-revised scales of Rs. 5000-8000, Rs. 5500-9000 and Rs. 6500-10500 recommended by the Sixth cpc.
As per CCS (RP) Rules, both of them will be granted grade pay of Rs. 4200 in the pay band PB-2. After the implementation of MACPS, two financial upgradations will be granted both in the case of (a) and (b) above to the next higher grade pays of Rs. 4600 and Rs. 4800 in the pay band PB.2

ILLUSTRATION-I

· lf a Government servant (LDC) in PB-l in the Grade Pay of Rs.19oo gets his first regular promotion (UDC) in the PB-l in the Grade Pay of Rs.2400 on completion of 8 years of service and then continues in the same Grade Pay for further 10 years without any promotion then he would be eligible for 2nd nnancial upgradation under the MACPS in the PB-l in the Grade Pay of Rs.2800 after completion of 18 years (8+10 years).
· (ii) ln case he does not get any promotion thereafter, then he would get 3rd financial upgradation in the PB-ll in Grade Pay of Rs.4200 on completion of further 10 years of service i.e. after 28 years (8+10+10).
· However, if he gets 2nd promotion after 5 years of further service in thepay PB-ll in the Grade Pay of Rs.4200 (Asstt. Grade/Grade "C") i.e. on completion of 23 years (8+1O+5years) then he would get 3rd financial upgradation after completion of 30 years i.e. 10 years after the 2nd ACP in the PB-ll in the Grade Pay of Rs.4600.
In the above scenario, the pay shall be raised by 3% of the total pay in the
Pay Band and Grade Pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion if
it is in the same Grade Pay or in the higher Grade Pay. Only the
difference of grade pay would be admissible at the time of promotions.

ILLUSTRATION-II

· If a Government servant (LDC) in PB-I in the Grade Pay of Rs.1900 isgranted 1st financial upgradation under the MACPS on completion of 10 years of service in the PB-l in the Grade Pay of Rs.2000 and 5 years later he gets 1st regular promotion (UDC) in PB-I in the Grade Pay of Rs.2400, the 2nd financial upgradation under MACPS (in the next Grade Pay w.r.t. Grade Pay held by Government servant) will be granted on completion of 20 years of service in PB-I in the Grade Pay of Rs.2800. On completion of 30 years of service, he will get 3rd ACP in the Grade Pay of Rs. 4200. However, if two promotions are earned before completion of 20 years, only 3rd financial upgradation would be admissible on completion of 10 years of service in Grade Pay from the date 2nd promotion or at 30th year of service, whichever is earlier.

ILLUSTRATION-III

· If a Government servant has been granted either two regular promotionsor 2nd financial upgradation under the ACP Scheme of August, 1999 after completion of 24 years of regular service then only 3rd financial upgradation would be admissible to him under the MACPS on completion of 30 years of service provided that he has not earned third promotion in the hierarchy

MODIFlED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE
CENTRAL GOVERNMENT CIVILIAN EMPLOYEES.
The Sixth Central Pay Commission in Para 6.1.15of its report, has recommended
Modified Assured Career Progression Scheme(MACPS). As per the recommendations,financial upgradation will be available in the next higher grade pay whenever an employee has completed 12 years continuous service in the same grade. However, not more than two financial upgradations shall be given in the entire career, as was provided in the previous Scheme. The Scheme will also be available to all posts belonging to Group "A" whether isolated or not. However, organised Group "A" services will not be covered under the Scheme
2. The Government has considered the recommendations of the Sixth Central Pay Commission for introduction of a MACPS and has accepted the same with further modification to grant three financial upgradations under the MACPS at intervals of 10, 20 and 30 years of continuous regular service.
3. The Scheme would be known as "MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES. This Scheme is in supersession of previous ACP Scheme and clarifications issued there under and shall be applicable to all regularly appointed Group "A", "B", and "C" Central Government Civilian Employees except officers of the Organised Group "A" Service. The status of Group "D" employees would cease on their completion of prescribed training, as recommended by the Sixth Central Pay Commission and would be treated as Group "C" employees. Casual employees, including those granted 'temporary status' and employees appointed in the Government only on adhoc or contract basis shall not qualify for benefits under the aforesaid Scheme. The details of the MACP Scheme and conditions for grant of the financial upgradation under the Scheme are given in Annexure-l.
4. An Screening Committee shall be constituted in each Department to consider the case for grant of financial upgradations uhder the MACP Scheme. The Screening Committee shall consist of a Chairperson and two members. The members of the Committee shall comprise officers holding posts which are at least one level above the grade in which the MACP is to be considered and not below the rank of Under Secretary equivalent in the Government. The Chairperson should generally be a grade above the members of the Committee.
5. The recommendations of the Screening Committee shall be placed before the Secretary in cases where the Committee is constituted in the MinistrylDepartment or before the Head of the organisation/competent authority in other cases for approval.
6. ln order to prevent undue strain on the administrative machinery, the Screening Committee shall follow a time-schedule and meet twice in a financial year - preferably in the first week of January and first week of July of a year for advance processing of the cases maturing in that half. Accordingly, cases maturing during the first-half (April- September) of a particular financial year shall be taken up for consideration by the Screening Committee meeting in the first week of January. Similarly, the Screening Committee meeting in the first week of July of any financial year shall process the cases that would be maturing during the second-half (October-March) of the same financial year.
7. However, to make the MACP Scheme operational, the Cadre Controlling Authorities shall constitute the first Screening Committee within a month from the date of issue of these instructions to consider the cases maturing upto 30th June, 2009 for grant of benefits under the MACPS.
8. ln so far as persons serving in The lndian Audit and Accounts Departments are concerned, these orders issue after consultation with the Comptroller and Auditor General of lndia.
9. Any interpretation/clarification of doubt as to the scope and meaning of the provisions of the MACP Scheme shall be given by the Department of Personnel and Training (Establishment-D). The scheme would be operational w.e.f. 01.09.2008. ln other words, financial upgradations as per the provisions of the earlier ACP Scheme (of August, 1999) would be granted till 31.08.2008.
10. No stepping up of pay in the pay band or grade pay would be admissible with regard to junior getting more pay than the senior on account of pay fixation under MACP Scheme.
11. It is clarified that no past cases would be re-opened. Further, while implementing the MACP Scheme, the differences in pay scales on account of grant of financial upgradation under the old ACP Scheme (of August 1999) and under the MACP Scheme within the same cadre shall not be construed as an anomaly.

BAD NEWS
It is worst than old ACP scheme. Orders are prepared on the line of Resolution dated 29.08.08. On ACP every one will get next higher grade pay in the hierarchy of Grade pay instead of hierarchy of posts
